Terms & Conditions

1          General Terms of Use 

1.1      These terms apply to the use of and submission of Content socially via SuperValu Ireland's Facebook, Twitter, Instagram, YouTube or Pinterest using #foodkarma and are effective from the 12th May 2016. 

2          Definitions 

"Content" means a creative expression and includes, without limitation, Recipes, Tips, videos, audio, photographs, images, illustrations, animations, logos, tools, written posts, replies, comments, information, data, text, software, scripts, executable files, graphics and interactive features, any of which may be generated, provided, or otherwise made accessible on or through the Services 

“Intellectual Property Rights” means patents, rights to inventions, copyright and related rights, trademarks, trade names and domain names, rights in get-up, rights in goodwill or to sue for passing off, rights in designs, rights in computer software, database rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications (or rights to apply) for, and renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which may now or in the future subsist in any part of the world. 

3          Submission of Content 

3.1      On submitting Content to our social media channels you assign to Musgrave all existing and future Intellectual Property Rights in the Content and all materials embodying such rights to the fullest extent permitted by law. Insofar as they do not so vest automatically by operation of law or under this agreement, you confirm that you hold legal title in such rights on trust for Musgrave. 

3.2      You undertake: 

3.2.2        not to register nor attempt to register any Intellectual Property Rights in the Content, unless requested to do so by Musgrave; and 

3.2.3        to do all acts necessary to confirm that absolute title in all Intellectual Property Rights in the Content has passed, or will pass, to Musgrave. 

3.3      You warrant to Musgrave that: 

3.3.1        you are unaware of any use by any third party of any of the Content or Intellectual Property Rights in the Content; and

3.3.2        the use of the Content or the Intellectual Property Rights in the Content by Musgrave will not infringe the rights of any third party 

3.4      You waive any moral rights in the Content to which you now or may at any future time be entitled under the Copyright and Related Rights Act 2000-2007 or any similar provisions of law in any jurisdiction, including (but without limitation) the right to be identified, the right of integrity and the right against false attribution, and agrees not to institute, support, maintain or permit any action or claim to the effect that any treatment, exploitation or use of such Content or other materials, infringes your moral rights. 

3.5      You acknowledge that, except as provided by law, is or may become due to you in respect of a successful submission of Content. 

3.6      You undertake, at the expense of Musgrave, at any time either during or after the submission of Content to the Sites, to execute all documents, make all applications, give all assistance and do all acts and things as may, in the opinion of Musgrave, be necessary or desirable to vest the Intellectual Property Rights in, and to register them in, the name of Musgrave and to defend Musgrave against claims that works embodying Intellectual Property Rights infringe third party rights, and otherwise to protect and maintain the Intellectual Property Rights in the Content. 

3.7      Musgrave will use any personal information that you provide with your submission of Content for the purposes of the Sites and where you have given your consent, for marketing purposes including the distribution of regular email updates or newsletters. Any personal information relating to entrants will be used solely by us in accordance with applicable data protection legislation. 

 

4          Draw Terms and Conditions 

4.1      The Draw entry is open from Thursday 12th of May 2016 and will run until SuperValu announces that the draw is now closed. Winning entrants will receive a SuperValu gift card to an amount of choosing by SuperValu.

 4.2      The winner will be contacted within two working days of the competition being drawn – please keep an eye out on our social media spaces for updates on the draw. In circumstances where the competition winner cannot be contacted after reasonable efforts SuperValu reserves the right to select another winner.

 4.3     In order to enter this draw, customers must post content socially via SuperValu Ireland's social channels using #foodkarma.

 4.4      This promotion is only open to entrants over 18 years of age and are resident in the Republic of Ireland or Northern Ireland. Employees of Supervalu, Musgrave Retail Partners Ireland, Musgrave Operating Partners Ireland and connected members of their families are excluded from the competition.

4.5      Persons entering the draw will be deemed to have accepted these terms and conditions of the draw. 

4.6      A person is permitted to enter as many times as they like until they win. However, if a person wins a draw, they can continue to submit content but will no longer be drawn as a competition winner

4.7     Entries must be strictly in accordance with these terms and conditions. Any entry not in strict accordance with these terms and conditions will be deemed to be invalid and no prizes will be awarded in respect of any such entry. Entries from agents/third parties are invalid.

4.8     SuperValu accepts no responsibility or liability for entries or information relating to entries that are lost or undelivered.

4.9     The winning entry will be picked at random from images received by SuperValu. The winner will be notified by phone or email.

4.10   The decision is final and no correspondence will be entered into.

4.11   SuperValu reserves the right to suspend or terminate the competition or amend these terms and conditions at any time for any valid technical or commercial reason.

4.12     The prize is as stated in these terms and conditions. However, SuperValu reserves the right at its sole discretion to alter the prize or substitute the prize.
